That isn't 100% true as things like SoundFlowerBed, Skype, Temperature
monitor, Butler etc. are OK as they use the StatusBar API.
http://developer.apple.com/documentation/Cocoa/Conceptual/StatusBar/StatusBar.html
This is also legit. These things won't command drag. Things which use the
Unsanity Menu Extra Enabler such as Rogue Amoeba SoundSource will still
command drag in my experience.
The whole premise of the Unsanity stuff appears to be "we could binary patch
random applications and do nasty unsafe and insecure things under Classic
MacOS why can't we do it under OS X mwwwwhhhaaaaa".
Unfortunately some mainstream developers and some popular open source
software for the Mac have chosen to use unsanity stuff to the detriment of
the whole platform, for example most uninformed observers will have blamed
Apple for the particular class of Leopard upgrade problems that were in fact
caused by the Unsanity Application Enhancer.

(Who still needs to get round to writing a replacement for SounceSource
which uses the SatusBar API)
